These Terms & Conditions apply to the Ember Fitness app (referred to as "Application") for mobile devices, created by Kennion Gubler (referred to as "Service Provider") as an ad-supported service.
By downloading or using the Application, you agree to these Terms & Conditions. Please read them carefully before using the Application. If you do not agree, do not use the Application.
Unauthorized copying or modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempt to extract the source code, translate the Application into other languages, or create derivative versions is not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
The Service Provider reserves the right to modify the Application or introduce charges for services at any time and for any reason. Any charges for the Application or its services will be clearly communicated to you before they take effect.
The Application offers in-app purchases (such as Remove Ads) processed entirely by Apple through StoreKit. The Service Provider does not receive or store your payment information. All billing inquiries should be directed to Apple.
The Application collects and processes personal data as described in our Privacy Policy (available at getemberfitness.com/privacy.html). It is your responsibility to maintain the security of your device and account. The Service Provider strongly advises against jailbreaking or rooting your device, as this may expose it to security vulnerabilities and may cause the Application to malfunction or become unavailable.
With your permission, the Application reads from and writes to Apple HealthKit to power workout tracking and progress features. You may revoke HealthKit access at any time in iOS Settings → Privacy & Security → Health. Health data is never sold or shared with third parties.
The Application uses your device's camera to analyze body position and count exercise repetitions in real time using on-device processing. No images or video are stored or transmitted to any server. You may revoke camera access at any time in iOS Settings → Privacy & Security → Camera.
The Application accesses your GPS location during run tracking workouts to map your route, calculate distance, and measure pace. Location is only active when you initiate a run. You may revoke location access at any time in iOS Settings → Privacy & Security → Location Services.
The Application uses the following third-party services, each governed by their own Terms & Conditions:
Certain features of the Application require an active internet connection. The Service Provider is not responsible if the Application does not function at full capacity due to lack of Wi-Fi or insufficient mobile data. If you use the Application outside a Wi-Fi area, your mobile carrier's standard rates apply, including potential roaming charges. By using the Application, you accept responsibility for any such charges.
The Service Provider cannot be held responsible for issues arising from your device, including a depleted battery preventing access to the Application.
While the Service Provider strives to keep the Application accurate and up to date, certain information and functionality depends on third-party services. The Service Provider accepts no liability for any direct or indirect loss resulting from reliance on such third-party functionality.
The Service Provider may update the Application periodically. Updates may be required to continue using the Application as operating system requirements evolve. The Service Provider does not guarantee indefinite compatibility with all OS versions. The Service Provider also reserves the right to discontinue the Application at any time without prior notice. Upon termination, your rights and licenses under these Terms will end and you must cease use of the Application.
These Terms & Conditions may be updated periodically. You are advised to review this page regularly. Continued use of the Application after changes are posted constitutes acceptance of the updated Terms.
